1. Civil mediation:

1.1  Civil mediation costs.

The costs of mediation conducted as a result of referral by a court (or other authorized body) are specified in the Regulation of the Minister of Justice of June 20, 2016 on the amount of remuneration and reimbursable expenses of the mediator
in civil proceedings (Journal of Laws 2016.921)

The mediator's remuneration and reimbursement of expenses related to the mediation shall be borne by the parties, as a rule, in equal parts, unless the parties agree on a different division of the accounts.

In non-property disputes and in property rights disputes in which the value of the subject of the dispute
it cannot be determined, the mediator's fee is PLN 150 for the first mediation session, and for each subsequent session - PLN 100 (not more than PLN 450 in total).

If the proceedings concern property rights, the mediator's remuneration is 1% of the value in dispute (not less than PLN 150 and not more than PLN 2,000 for the entire mediation procedure).

The mediator's expenses incurred in connection with the mediation are also reimbursed (including the fee for renting the room up to PLN 70 for one meeting and the costs of correspondence, in the amount not exceeding PLN 30).

If the mediator is a taxpayer obliged to settle the tax on goods and services, VAT is added to the mediation costs.

If a settlement is reached before the hearing begins, the party will be reimbursed 100% of the court fees that it had paid in bringing the case to court. If a settlement is reached before the mediator at a later stage of the court proceedings (after the hearing has commenced), the party will be reimbursed 75% of the court fee.

Regardless of the outcome of the case, the court may require a party to reimburse the costs arising from an obviously unjustified refusal to participate in mediation.

A party to mediation proceedings may submit an application for exemption from mediation costs on general terms.

2. Mediation in criminal matters:

2.1 Criminal Mediation Costs

The costs of mediation conducted as a result of referral by a court (or other authorized body) are specified in the Ordinance of the Minister of Justice of June 18, 2003 on the amount and method of calculating State Treasury expenses in criminal proceedings (Journal of Laws 2013, 663 cents).

The costs of mediation (mediator's remuneration and reimbursement of expenses related to mediation) are borne by the State Treasury and amount to: PLN 120 for conducting the mediation procedure and PLN 20 for delivering summons and other letters.

 3. Mediation in juvenile cases:

3.1 Mediation costs in juvenile cases

The costs of mediation conducted as a result of referral by a court (or other authorized body) are specified in the Ordinance of the Minister of Justice of August 14, 2001 on the amount and detailed rules  determining the costs of proceedings in juvenile cases (Journal of Laws of 2013, 640 cU).

The costs of mediation (mediator's remuneration and reimbursement of expenses related to mediation) are borne by the State Treasury and amount to: PLN 187.38 for conducting the mediation procedure and PLN 20 for delivering summons and other letters.
